Installation & Product Liability
OnTint products are sold for installation at the customer's own risk. Professional installation is strongly recommended for Electronic SPD Tint Film. Smart Film EOOD accepts no liability for damage arising from incorrect installation, application of incorrect voltage or power supply, physical modification of the product, or removal of protective layers prior to or during installation. Damage caused by any of the above does not constitute a manufacturing defect and is not eligible for return, refund, or warranty claim under any applicable law.

Customisation options including vehicle make, model, and window configuration are selected solely by the customer at checkout. Smart Film EOOD is not liable for orders placed with incorrect vehicle or window specifications.


Intellectual Property
All content on ontint.com — including product imagery, video, written descriptions, technical specifications, and branding — is the intellectual property of Smart Film EOOD. Reproduction, redistribution, or commercial use of any content without prior written permission is strictly prohibited.


Governing Law & Jurisdiction
These terms and all purchase contracts entered into via ontint.com are governed by the laws of the Republic of Bulgaria. Any disputes arising from a purchase on ontint.com are subject to the jurisdiction of the competent courts of Bulgaria, unless mandatory consumer law in your country of residence grants you the right to bring proceedings locally. EU consumers retain all mandatory rights under the consumer protection laws of their country of residence and may contact the European Consumer Centre network for assistance with cross-border disputes.


Chargeback & Payment Dispute Fraud
Filing a chargeback is a last-resort remedy provided by card networks for genuine unresolved disputes. It is not a substitute for contacting us directly. Before initiating any card dispute, you are contractually required to contact us at smartfilmeood@outlook.com and allow a minimum of 5 business days for us to investigate and resolve your issue. Failure to follow this procedure will be documented and submitted as evidence against your claim to the relevant card network.

The following do not constitute valid grounds for a chargeback and will be vigorously disputed:

Claiming non-receipt when tracked carrier proof of delivery exists confirming delivery to your address; claiming a product is defective when damage was caused by incorrect installation, incorrect power supply, or customer misuse; filing a chargeback after already receiving a refund from us for the same transaction; returning a product and simultaneously filing a chargeback for the same order; disputing a transaction you confirmed in writing via invoice, email, or direct message; changing your mind after an order has been dispatched; failing to collect a package from a carrier collection point after a delivery attempt.

Criminal Liability
Filing a knowingly false chargeback constitutes fraud. Across the European Union, this may constitute a criminal offence under Article 209 of the Bulgarian Criminal Code and under national implementations of EU Directive 2019/713 on combating fraud and counterfeiting of non-cash means of payment, carrying penalties including fines and imprisonment.

In the United States, filing a false chargeback may constitute wire fraud under 18 U.S.C. § 1343 and theft or larceny under applicable state law, including California Penal Code § 484 and New York Penal Law § 155, punishable by fines and imprisonment. These are not warnings - they are statements of applicable law in the jurisdictions we serve.

Civil Recovery
Where Smart Film EOOD determines that a chargeback was filed fraudulently or in bad faith, we reserve the right to pursue civil legal proceedings against the customer for the full disputed amount, all chargeback and dispute fees imposed on us, and reasonable legal and administrative costs. Proceedings may be initiated before the competent courts of Varna, Bulgaria, or — where applicable — in the courts of the customer's country of residence using EU cross-border enforcement mechanisms or applicable international enforcement procedures for customers outside the EU. We exercise this right proportionately and focused on cases where evidence of intentional fraud is clear.

Evidence Retention
Smart Film EOOD retains the following records for a minimum of 36 months in connection with every order: order confirmation and customer-provided details, carrier proof of delivery documents and delivery photographs, full shipment tracking history, complete customer communications across all channels, checkout session logs confirming policy acceptance, and IP address and device data associated with each transaction. In the event of a chargeback, a complete evidence package is submitted to the card network within 48 hours of notification. Our payment processor is notified of all suspected fraudulent disputes.
